Special leave for parents and relatives of people with disabilities

On January 18, Law 19.729 was published, creating two new special leaves for workers in the private sector, in addition to those regulated by Law 18.345 (leave for study, paternity, adoption, adoptive legitimation, marriage and mourning).


1. Special leave for workers with children with disabilities:

This act establishes that every worker who has a child with a disability according to Law 19.691,will have the right to request up to a total of 10 annual days of leave paid, for medical checks of that child.

The communication of the use of these days to the employer must be made at least 48 hours in advance.

Likewise, the employee must prove the reason that gave rise to the request for said leave by presenting the medical certificate.

 

2. Special leave for a worker in charge of family members with a disability or terminal illness:

The law also creates a special 96 hours annual leave that may be usufructuated continuously or discontinuously, for every worker who is in charge of family members with a disability or terminal illness according to Law 19,691. From that period, 64 hours will be paid by the employer.

The act also provides that this special license may be regulated by the Executive Power, the Salary Councils or collective agreements.
