NEW REGULATION ON AIR QUALITY

On May 13, 2021, the new Decree 135/021 from the Executive Branch was published in the Official Gazette, which establishes new regulations on air quality. The purpose of the Decree is to contribute to the protection of the environment, through the prevention of air pollution.


Until now, Uruguay did not have national standards that establish air quality objectives and acceptable emission limits for the different potentially polluting activities in the atmosphere.


The new regulation establishes the obligation to comply with certain emission standards, both for fixed and mobile sources, as well as the obligation to obtain an Emission Authorization from the Ministry of Environment for certain activities. The new Decree also details the specific infractions to the regulation and establishes the sanctions regime and a graduation system that can reach penalties for an amount of up to 100,000 UR (approx. USD 3,041,178) in the most serious cases.
